15% Transition Surcharge

Overview

Section 11 of the America Invents Act implements a fifteen percent fee increase to all fees charged or authorized by 35 U.S.C. § 41 subsections (a), (b), and (d)(1) and 35 U.S.C. § 132(b). This was done to prevent funding limitations until the Office can establish fees using its fee setting authority.

Upcoming Events/Key Dates

This fee increase went into effect on September 26, 2011, and will terminate when the Office establishes fees using the fee setting authority granted to it by Congress in section 10 of the America Invents Act, which is expected on October 5, 2012.
