Effects of First-to-File on Small Businesses

Overview

Congress requires the Office to conduct a study on the effects a first-to-file system will have on small businesses.

The America Invents Act sets out a number of issues the study should address, including: 1) how the change to a first-to-file system will affect the ability of small businesses to obtain patents; 2) whether the change will create advantages or disadvantages for small businesses; and 3) what cost savings or other potential benefits might affect small businesses.

Upcoming Events/Key Dates

This report must be submitted to Congress by September 16, 2012. It is expected that the USPTO will provide a time before September 16 in which comments may be submitted for consideration regarding this topic.
